Online gambling could face constitutional questions in Ohio

CLEVELAND, Ohio — Dan Gilbert is positioned to be a player in the emerging Internet gambling market, but a state constitutional amendment that he championed might make it hard for him to capitalize on the trend in Ohio. The unique 2009 amendment physically restricts casino gambling to parcels occupied by Gilbert’s Horseshoe casinos in Cleveland and Cincinnati and the Hollywood casinos that Penn National Gaming operates in Columbus and Toledo. Matthew Schuler, executive director of the Ohio Casino Control Commission , goes to conferences and hears regulators from other states openly wonder whether the amendment would prohibit online betting. Christy Prince, an attorney who practices gaming law for the Columbus firm of Kegler Brown Hill & Ritter, said those observers have grounds for speculation. “It says casino gaming can take place in the following four locations,”she said “If I want to go home tonight and play poker . . . there’s an argument that I can’t go and play it on my computer.” Ohio could employ a bit of “legal fiction” to comply with the constitution, said I. Consumers will win with a new entertainment option that they can play from the comfort of a coffee shop or their own sofa. Everybody, it seems, is guaranteed to win. Except Atlantic City itself. New Jersey is rolling out legalized Internet gambling, betting that it will help casinos fend off fierce competition from neighboring states, bolster the state’s tax revenue and be a powerful economic engine once again. Online Gambling Window Closing for States

Most state legislatures have adjourned for 2013.   Despite attempts in several states, it appears that there will be no new entries into the regulated online gambling industry this year.   Representative Peter King (R-NY) took notice and introduced a federal bill that would legalize online gambling in the US, provided states do not opt out.   This proposal would recognize existing state online gambling laws if his bill were to pass.   Regardless of the real chances of Rep. King’s bill becoming law, it is a wakeup call to states that are looking to preserve their gambling rights.   California took notice well before Rep. King’s bill was released.   Tribal gaming interests proposed bills that would automatically opt the state out of any future online gambling regulation.   Utah took the opposite approach, as it will automatically opt out of any federal legislations that include online gambling.   Washington State did the same by making online poker a felony for both operators and players, though there are attempts to repeal this law .   Delaware, Nevada and New Jersey have embraced online gambling to a certain degree.   Delaware has already legislated online poker and casino games [...]

Policewoman ‘stole mobile phone from casino on drunken night out’

A drunken policewoman on a colleague’s retirement night out entered the staff room of a casino and stole a mobile phone and a charger, a court has heard. Former Dyfed-Powys Police officer Ceri Ann Rees, 35, of Llanelli, who had been celebrating with police colleagues in the centre of Swansea in October 2011, later said she had drunk “quite a few” double vodkas plus some sparkling pink wine. At Swansea Crown Court on Wednesday, where she denies a single charge of burglary, she explained to the jury that two months after the alleged incident on October 2, 2011, she was dismissed from Dyfed-Powys Police for misconduct. Francis Jones, prosecuting, said after Rees and police officer colleague Samantha Dawson visited the Pump House and Bank Station pubs in Swansea’s Wind Street where they met other Dyfed-Powys Police officers, they went to the city’s Aspers casino for a meal. Mr Jones said Rees went into the casino staff room, sprayed herself with body spray taken from a handbag, then walked off with a mobile phone and charger belonging to casino worker Ceinwen Jones. Reports indicate that the mafia relies heavily on German online gambling sites to launder money. The police are powerless in the situation due to unclear laws, which the European Court of Justice is now set to review. Human trafficking, forced prostitution and drugs represent huge sources of revenue for the mafia. A current UN study estimates that organized crime rakes in 2.1 billion dollars (1.56 billion euros) a year. But what use is all of that money if there’s no way to put it into legal circulation? That’s an essential question for the mafia, which must find ways to shuffle cash back into the legal marketplace. “Money laundering is no trivial offense. Instead, it represents a key issue for organized crime,” said University of Hamburg economist Ingo Fiedler, who has done extensive research on online gambling, in an interview with DW. “If there were no money laundering, there wouldn’t be a mafia,” he added.
